AN ACT TO AMEND SECTION 1, CHAPTER 411, LAWS OF 2011, TO PROVIDE FOR THE EXTINGUISHMENT OF THE REVERTER CLAUSE ON THE PROPERTY DONATED TO TOUGALOO COLLEGE FOR PURPOSES OF BENEFITTING THE MEDGAR EVERS HOME, UPON THE CONDITION THAT THE DONATED PROPERTY IS TRANSFERRED AND CONVEYED TO THE NATIONAL PARK SERVICE OR ANY AGENCY OF THE UNITED STATES GOVERNMENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 1, Chapter 411, Laws of 2011, is amended as follows:

     Section 1.  (1)  The Department of Finance and Administration, acting on behalf of the Mississippi Department of Archives and History, is authorized to donate to Tougaloo College, all of the rights, title and interest in certain real property under the possession and control of the Department of Archives and History, located in the First Judicial District of Hinds County, Mississippi, subject to the requirements and conditions prescribed in subsection (2) of this section.  The property is more particularly described as follows:

Lots 12 and 13, Block 42, Elraine Resurvey, Part 2, a subdivision according to a map or plat thereof which is on file and of record in the Office of the Chancery Clerk of Hinds County at Jackson, Mississippi, recorded in Plat Book 4 at Page 71, reference to which is hereby made in aid of and as a part of this description;

AND

Lot 14, Block 42, Elraine Resurvey, Part 2, a subdivision according to a map or plat thereof which is on file and of record in the Office of the Chancery Clerk of Hinds County at Jackson, Mississippi, recorded in Plat Book 4 at Page 71, reference to which is hereby made in aid of and as a part of this description.

     (2)  If at any time after the donation of the real property described in subsection (1) of this section Tougaloo College ceases to use the real property for the purposes intended at the time of donation, Tougaloo College shall forfeit its rights, title and interest in the real property, and all of the rights, title and interest in the real property shall revert back to the State of Mississippi, to be held for the use and benefit of the Mississippi Department of Archives and History, unless said property is transferred and conveyed to the National Park Service or any agency of the United States government.  Upon an agreement between Tougaloo College and the National Park Service or any agency of the United States government for the transfer of the real property described in this section, the reverter clause shall be extinguished, and the State of Mississippi shall relinquish its claim to all rights, title and interest in the real property.

     (3)  The State of Mississippi shall retain all mineral rights in the property donated under the provisions of this section.  However, upon transfer and conveyance to the National Park Service or any agency of the United States government, the State of Mississippi shall transfer all mineral rights to the National Park Service or the agency of the United States government gaining possession the real property.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
