Summary
An Act To Create New Section 63-17-114, Mississippi Code Of 1972, To Provide That Certain Funds Received By A Motor Vehicle Dealer In A Transaction Involving The Purchase Or Trade-in Of A Vehicle Are Trust Funds Held In Trust By The Motor Vehicle Dealer For Certain Entities; To Provide That Certain Funds Held By A Manufacturer That Are Necessary To Perform The Obligation Of The Manufacturer To Motor Vehicle Dealers Or Customers Are Trust Funds Held In Trust By The Manufacturer For The Motor Vehicle Dealer Or Customers; To Provide That The Holder Of The Trust Funds May Not Grant Any Security Or Other Interest In Such Funds; To Create New Section 63-17-118, Mississippi Code Of 1972, To Provide For The Compensation Of Motor Vehicle Dealers Upon Termination, Cancellation, Refusal To Continue Or Refusal To Renew A Franchise Or Upon Discontinuation Of Any Line Make; To Amend Section 63-17-55, Mississippi Code Of 1972, To Define Certain Terms; To Amend Section 63-17-73, Mississippi Code Of 1972, To Prohibit Certain Actions By A Motor Vehicle Manufacturer, Distributor, Wholesaler, Distributor Branch Or Division, A Factory Branch Or Division, Or A Wholesaler Branch Or Division; To Amend Section 63-17-117, Mississippi Code Of 1972, To Provide That Any Audit For Warranty Parts Or Service Compensation Shall Be Performed Within The Six-month Period Immediately Following The Date Of The Payment Of The Disputed Claim By The Manufacturer Or Distributor, And That Any Audit For Sales Incentives, Service Incentives, Rebates Or Other Forms Of Incentive Compensation Shall Be Performed Within The Nine-month Period Immediately Following The Date Of The Payment Of The Disputed Claim By The Manufacturer Or Distributor; To Repeal Section 63-17-141, Mississippi Code Of 1972, Which Provides For The Duties Of Dealers And Manufacturers Or Distributors Upon Termination Or Nonrenewal Of Motor Vehicle Franchise Agreements; And For Related Purposes.
