Summary

An Act To Amend Section 63-21-30, Mississippi Code Of 1972, To Provide A Procedure For Retiring The Title To A Manufactured Home Or Mobile Home That Has Become Affixed To Real Property By Recording An Affidavit Of Affixation With The Chancery Clerk Of The County In Which The Real Property Is Located; To Provide That The Affidavit Must Contain Or Be Accompanied By Certain Information; To Provide That The Chancery Clerk Shall Forward A Copy Of The Recorded Affidavit Of Affixation To The County Tax Assessor To Assist In Locating And Identifying The Manufactured Home Of Mobile Home For Property Tax Purposes; To Provide That The Owner Must File An Application With The Department Of Revenue For Retirement Of The Title; To Provide The Contents Of Such Application; To Provide That If The Owner Of A Manufactured Home Or Mobile Home That Has Been Affixed To Real Property Wishes To Detach Or Sever The Home From The Real Property, The Owner May File An Affidavit Of Severance With The Chancery Clerk Of The County In Which The Real Property Is Located; To Provide The Contents Of Such Affidavit; To Provide That The Chancery Clerk Shall Forward A Copy Of The Recorded Affidavit Of Severance To The County Tax Assessor To Assist In Locating And Identifying The Manufactured Home Of Mobile Home For Property Tax Purposes; To Provide That If A Manufactured Home Or Mobile Home Is Destroyed Or Otherwise Becomes Uninhabitable And The Owner Desires To Document This, He May File An Affidavit Of Destruction In The Official Records Of The Chancery Clerk Of The County In Which The Real Property Is Located; To Provide The Content Of Such Application; To Provide That The Chancery Clerk Shall Forward A Copy Of The Recorded Affidavit Of Destruction To The County Tax Assessor To Assist In Locating And Identifying The Manufactured Home Of Mobile Home For Property Tax Purposes; To Provide That The Owner Of A Mobile Home Whose Certificate Of Title Has Been Retired And Who Has Recorded An Affidavit Of Severance Must File An Application With The Department Of Revenue For The Issuance Of The New Certificate Of Title; To Provide For The Contents Of Such Application; To Provide For The Issuance Of A New Certificate Of Title By The Department Of Revenue; To Provide That A Manufactured Or Mobile Home Whose Title Has Been Retired Must Be Conveyed By Deed Or Other Real Property Contract Together With The Property To Which It Is Affixed Unless The Procedures Described In This Act For Severance Or Destruction And Issuance Of A New Title Are Followed; To Provide The Form Of Affidavits Of Destruction, Severance And Destruction; To Amend Sections 27-53-15 And 27-53-5, Mississippi Code Of 1972, In Conformity Thereto; And For Related Purposes.
