Summary
An Act To Provide That Applicants For And Recipients Of Medicaid Benefits Who Are 13 Years Of Age Or Older Shall Be Required To Take A Drug Test To Determine Their Eligibility To Receive Or Continue Receiving The Benefits; To Provide That If An Applicant For Or Recipient Of Medicaid Benefits Tests Positive For Any Prohibited Drug, The Applicant Or Recipient Shall Not Be Eligible To Receive The Benefits For A Period Of Not Less Than 90 Days; To Provide That After That Period, A Person May Reapply To Receive Medicaid Benefits And Will Be Eligible To Receive The Benefits If The Person Passes Another Drug Test; To Direct The Division Of Medicaid To Enter Into An Agreement With The State Department Of Health For The Department To Perform The Drug Testing Of Medicaid Applicants And Recipients; To Provide That The Cost Of The Initial Drug Test Shall Be Paid In Equal Parts By The Division And The Department; To Provide That Persons Failing To Pass The Initial Drug Test Shall Be Responsible For Paying The Cost Of Any Later Tests; To Direct The Division To Apply For A Federal Waiver To Allow For The Implementation Of The Provisions Of This Section; To Provide That The Provisions Of This Section Shall Be Implemented To The Maximum Extent Allowed By The Federal Waiver; To Amend Section 43-13-115, To Conform To The Provisions Of This Act; And For Related Purposes.
