Summary

An Act To Create A New Section Of Law In Chapter 35, Title 73, Mississippi Code Of 1972, To Require That An Applicant For A Mississippi Real Estate Broker's License, Or A Mississippi Resident License As A Real Estate Salesperson, Or A Non-resident License In Mississippi And All Applicants For Renewal Of A Mississippi Real Estate Broker's License, Or A Mississippi Resident License As A Real Estate Salesperson, Or A Non-resident License In Mississippi Submit To A Fingerprint-based Criminal History Records Check Of The Mississippi Central Criminal Database And The Federal Bureau Of Investigation Criminal History Database For The Purpose Of Determining That The Applicant Does Not Possess A Background Which Calls Into Question Public Trust; To Provide That The Information Collected From The Fingerprint-based Criminal History Records Check Shall Be Exempt From The Mississippi Public Records Act; To Provide The Consent And Fee Requirements Of The Fingerprint-based Criminal History Records Check; To Provide That The Mississippi Real Estate Commission Shall Not Issue A License To An Applicant Who Possesses A Background That Calls Into Question The Applicant's Ability To Maintain Public Trust; To Amend Sections 73-35-7, 73-35-8, 73-35-21 And 73-35-18, Mississippi Code Of 1972, To Conform To The Provisions Of This Act; And For Related Purposes.
