AN ACT

To amend chapter 287, RSMo, by adding thereto one new section relating to workers' compensation insurance.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 287, RSMo, is amended by adding thereto one new section, to be known as section 287.032, to read as follows:

            287.032. 1. This section shall be known as the "Family Business Growth Act".

            2. Notwithstanding any provision of this chapter to the contrary, up to two members of the employer's family within the third degree of affinity may opt out of workers' compensation insurance under this chapter, but such members shall be counted toward the total number of employees provided under subdivision (3) of subsection 1 of section 287.030.

            3. This section shall not affect any employee currently receiving workers' compensation under this chapter or any other insurance mandated by the state.

            4. The provisions of this section shall sunset on August 28, 2015.
