AN ACT

To amend chapter 630, RSMo, by adding thereto one new section relating to closure or downsizing of state operated mental health facilities, with an emergency clause.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 630, RSMo, is amended by adding thereto one new section, to be known as section 630.555, to read as follows:

            630.555. Prior to closure or downsizing of any state facility operated by the department of mental health, the director of the department shall submit a cost-benefit analysis of and written plan for the closure or downsizing of the facility to the senate and the house appropriations committees on mental health for their consideration.

            Section B. Because immediate action is necessary to the proper care and treatment of patients in state-operated mental health facilities, section A of this act is deemed necessary for the immediate preservation of the public health, welfare, peace, and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and section A of this act shall be in full force and effect upon its passage and approval.
