AN ACT

To amend chapter 160, RSMo, by adding thereto one new section relating to school district performance.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 160, RSMo, is amended by adding thereto one new section, to be known as section 160.955, to read as follows:

            160.955. 1. Notwithstanding any provision of this chapter, any state regulation, or any other provision of law, all unaccredited school districts and provisionally accredited school districts in the state shall regain accredited status, effective August 28, 2014. Prior to the 2015-16 school year, the department of elementary and secondary education shall establish a task force to create a system for evaluating school district performance based on standards that are independent from the Show-Me Standards or the Missouri academic standards established in the Outstanding Schools Act of 1993. Beginning in school year 2015-16, and each year thereafter until the 2025-26 school year, the task force shall conduct yearly evaluations of each school district in the state and report its findings to the department of elementary and secondary education by July first each year. On or before December 1, 2025, the task force shall submit a report to the general assembly with findings as to school performance and recommendations regarding methods for evaluating school districts, individual schools, and student performance.

            2. The department of elementary and secondary education shall promulgate rules to implement the provisions of this section. Any rule or portion of a rule, as that term is defined in section 536.010, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536 to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2014, shall be invalid and void.
