AN ACT

To amend chapter 217, RSMo, by adding thereto one new section relating to an offender making a false report against an employee of the department of corrections, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 217, RSMo, is amended by adding thereto one new section, to be known as section 217.387, to read as follows:

            217.387. 1. No offender shall make a false report against any employee of the department by knowingly giving false information to an employee of the department for the purpose of implicating any employee of the department in a crime.

            2. It is a defense to a prosecution under subsection 1 of this section that the offender retracted the false information before any employee of the department took substantial action in reliance thereon.

            3. The offender shall have the burden of injecting the issue of retraction under subsection 2 of this section.

            4. Violation of subsection 1 of this section is a class D felony.
