AN ACT

To amend chapter 407, RSMo, by adding thereto one new section relating to the resale of a repaired motor vehicle, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.557, to read as follows:

            407.557. 1. Any vehicle repaired by a body shop authorized by the owner's insurance company following a traffic accident shall be deemed adequately repaired if the itemized estimate is approved by the insurance company and used as a guideline to complete the repairs. The repaired vehicle shall not be subject to diminished value when such vehicle is traded or sold at an automobile dealership or when traded or sold to an individual. The basic value of the vehicle shall be determined by the estimated value listed in publications such as Kelly Blue Book or the National Automobile Dealers Association (N.A.D.A.) taking into consideration the condition of the vehicle when traded.

            2. Any attempt to diminish the value of a vehicle at the time of sale when it meets the criteria described in subsection 1 of this section shall be guilty of a class B misdemeanor.
