AN ACT

To amend chapter 566, RSMo, by adding thereto one new section relating to aggravating factors for sexual offenses.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 566, RSMo, is amended by adding thereto one new section, to be known as section 566.133, to read as follows:

            566.133. 1. Any person found guilty of or who pleads guilty to any sexual offense under chapter 566, 568, or 573, shall be sentenced one classification higher than the underlying offense if the person commits the offense with a victim who is:

            (1) His or her ancestor or descendant by blood or adoption;

            (2) His or her stepchild, while the marriage creating that relationship exists;

            (3) His or her brother or sister of the whole or half-blood; or

            (4) His or her uncle, aunt, nephew, or niece of the whole blood.

            2. The provisions of subsection 1 of this section shall not apply to a person found guilty of or who pleads guilty to a violation of section 568.020.
