AN ACT

To amend chapter 407, RSMo, by adding thereto one new section relating to credit card transactions.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.435, to read as follows:

            407.435. No seller or lessor in a sales or lease transaction, or any credit card issuer, shall impose a surcharge on a cardholder who elects to use a credit card in lieu of payment by cash, check, or similar means. A surcharge shall mean any additional amount imposed at the time of the sale or lease transaction by the merchant, seller, or lessor that increases the charge to the buyer or lessee for the privilege of using a credit card.
