AN ACT

To amend chapter 578, RSMo, by adding thereto one new section relating to the crime of agricultural production facility fraud, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 578, RSMo, is amended by adding thereto one new section, to be known as section 578.660, to read as follows:

            578.660. 1. A person commits the crime of agricultural production facility fraud if the person willfully does any of the following:

            (1) Obtains access to an agricultural production facility by false pretenses;

            (2) Makes a false statement or representation as part of an application or agreement to be employed at an agricultural production facility, if the person knows the statement to be false, and makes the statement with an intent to commit an act not authorized by the owner of the agricultural production facility, knowing that the act is not authorized.

            2. A person who commits the crime of agricultural production facility fraud is guilty of a class B misdemeanor. Any second or subsequent violation is a class A misdemeanor.

            3. Any person who aids, abets, acts in concert, or otherwise participates, directly or indirectly, in the commission of the crime is guilty of the crime of agricultural production facility fraud.

            4. A person who conspires to commit the crime of agricultural production facility fraud is subject to the provisions of section 564.016.
