AN ACT

To repeal section 21.110, RSMo, and to enact in lieu thereof one new section relating to vacancies in public office.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Section 21.110, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 21.110, to read as follows:

            21.110. If the governor receives any resignation or notice of vacancy, or if he is satisfied of the death of any member of either house, during the recess, he shall, without delay in all cases and within thirty days in any case where the remaining term of such office upon notice of vacancy to the governor is greater than one year, issue a writ of election to supply the vacancy. All writs issued by the governor to supply such vacancies shall require the election to be held at the next general municipal election day, primary election day, or general election day, whichever occurs the earliest after notice of the vacancy to the governor, except that the governor may designate a subsequent election day if general law requiring notice or other time limitations for holding elections so requires.
