AN ACT

To amend chapter 253, RSMo, by adding thereto one new section relating to liability insurance for events in state parks.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 253, RSMo, is amended by adding thereto one new section, to be known as section 253.075, to read as follows:

            253.075. 1. All events open to the public in a state park or on a historic site that are sponsored or cosponsored by outside groups shall carry liability insurance unless specifically exempt by this section.

            2. Activities held at a state park that do not require liability insurance include the following:

            (1) Fishing derbies sponsored by the chamber of commerce fishing clubs;

            (2) Antique car shows sponsored by the chamber of commerce car clubs;

            (3) Driving tours sponsored by car and motorcycle clubs;

            (4) Art show sponsored by art clubs;

            (5) Horseshow pitching tournaments sponsored by civic organizations;

            (6) Easter egg hunts sponsored by civic organizations;

            (7) Jam sessions or community concerts sponsored by music groups, bluegrass clubs, civic organizations, or school groups.

            3. All organizations wanting to sponsor a special event or activity identified in this subsection in a state park or on a historic site shall provide a minimum amount of coverage of one hundred thousand dollars per person and one million dollars per occurrence. Such events and activities include, but are not limited to, the following:

            (1) Adventure race;

            (2) Bike tour or bike race;

            (3) Church service or religious event;

            (4) Craft festival with premade gifts;

            (5) Cross-country meet/marathon;

            (6) Geocaching/letterboxing;

            (7) Music concert/jam sessions held in a venue that holds one hundred and one to less than three hundred people;

            (8) Orienteering;

            (9) Reception/open house;

            (10) Swap meet;

            (11) Swimming;

            (12) Triathlons;

            (13) Volksmarch;

            (14) Walk-a-thon.

            4. All organizations wanting to sponsor a major special event or any activity that involves the use of mechanized vehicles, firearms, or other activity listed in this subsection in a state park or on a historic site shall provide a minimum amount of coverage of two million dollars per occurrence. Events and activities include, but are not limited to, the following:

            (1) Aircrafts;

            (2) Alcohol sales;

            (3) Bounce house;

            (4) Living history events with use of firearms;

            (5) Craft festivals with onsite creation/demonstration (i.e. period crafts, ironworks);

            (6) Events including firearms or other explosives;

            (7) Horses or horseback riding;

            (8) Hot air balloons;

            (9) Mechanized vehicles;

            (10) Music festivals held in a venue that holds more than three hundred people;

            (11) Personal watercraft/boats;

            (12) Wagon rides.
