AN ACT

To amend chapter 115, RSMo, by adding thereto one new section relating to candidate qualifications.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 115, RSMo, is amended by adding thereto one new section, to be known as section 115.352, to read as follows:

            115.352. Notwithstanding any other provision of law to the contrary, no person shall qualify as a candidate for elective public office in this state who is currently in violation of a court order to pay any monetary judgement that is owed to this state, an agency of this state charged with the enforcement of debts, or any political subdivision of this state, including but not limited to a judgment for child support payments. No such person's name shall appear on any ballot as a candidate for any elective public office in this state. Each election authority shall conduct an inquiry of the appropriate court to determine whether the person is currently in violation of a court order when such person attempts to file a declaration of candidacy. The election authority may also request the office of the attorney general or any local elected official to make such inquiry.
