AN ACT
To repeal section 252.002, RSMo, and to enact in lieu thereof one new section relating to the conservation commission.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 252.002, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 252.002, to read as follows:
252.002. 1. There is hereby created a department of conservation to be headed by a conservation commission of [four] seven members appointed by the governor, by and with the advice and consent of the senate, not more than [two] four of whom shall be of the same political party, with one member representing St. Louis, one member representing Kansas City, and each of the remaining five members representing and residing in a different region of the state. For purposes of appointing the five regional members to the commission, the department of conservation shall divide the remainder of the state, other than St. Louis and Kansas City, into the following five regions of substantially equal population in each region: northwest, northeast, central, southwest, and southeast. The members shall have knowledge of an interest in wildlife conservation. The members shall hold office for terms of six years beginning on the first day of July of consecutive odd years. Three of the terms shall be concurrent; two shall begin two years before and two shall begin two years after the concurrent terms. If the governor fails to fill a vacancy within thirty days, the remaining members shall fill the vacancy for the unexpired term. The members shall [have the qualifications, serve the terms and] receive the expense reimbursement provided in Article IV, Section 40(a) of the Constitution of Missouri. The commission shall appoint a director of the department of conservation who with its approval shall appoint assistants and other employees.
2. All the powers, duties and functions of the conservation commission, chapters 252, 254, and others, are transferred by type I transfer to the department of conservation.
3. The amendments to this section shall not become effective except upon the passage of a constitutional amendment authorizing the number, qualifications, and terms of the members of the conservation commission to be fixed by law.
