1.1A bill for an act
1.2relating to education finance; increasing funding for extended time and area
1.3learning center programs;amending Minnesota Statutes 2012, sections 126C.05,
1.4subdivision 8; 126C.10, subdivision 2a.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 126C.05, subdivision 8, is amended to read:
1.7    Subd. 8. Average daily membership. (a) Membership for pupils in grades
1.8kindergarten through 12 and for prekindergarten pupils with disabilities shall mean the
1.9number of pupils on the current roll of the school, counted from the date of entry until
1.10withdrawal. The date of withdrawal shall mean the day the pupil permanently leaves
1.11the school or the date it is officially known that the pupil has left or has been legally
1.12excused. However, a pupil, regardless of age, who has been absent from school for 15
1.13consecutive school days during the regular school year or for five consecutive school days
1.14during summer school or intersession classes of flexible school year programs without
1.15receiving instruction in the home or hospital shall be dropped from the roll and classified
1.16as withdrawn. Nothing in this section shall be construed as waiving the compulsory
1.17attendance provisions cited in section 120A.22. Average daily membership equals the
1.18sum for all pupils of the number of days of the school year each pupil is enrolled in the
1.19district's schools divided by the number of days the schools are in session. Days of
1.20summer school or intersession classes of flexible school year programs are only included
1.21in the computation of membership for pupils with a disability not appropriately served
1.22primarily in the regular classroom. A student must not be counted as more than 1.2 1.5
1.23 pupils in average daily membership under this section. When the initial total average daily
2.1membership exceeds 1.2 1.5 for a pupil enrolled in more than one school district during
2.2the fiscal year, each district's average daily membership must be reduced proportionately.
2.3(b) A student must not be counted as more than one pupil in average daily
2.4membership except for purposes of section 126C.10, subdivision 2a.
2.5EFFECTIVE DATE.This section is effective for revenue for fiscal year 2014
2.6and later.

2.7    Sec. 2. Minnesota Statutes 2012, section 126C.10, subdivision 2a, is amended to read:
2.8    Subd. 2a. Extended time revenue. (a) A school district's extended time revenue is
2.9equal to the product of $4,601 the basic formula allowance and the sum of the adjusted
2.10marginal cost pupil units of the district for each pupil in average daily membership in
2.11excess of 1.0 and less than 1.2 1.5 according to section 126C.05, subdivision 8.
2.12(b) A school district's extended time revenue may be used for extended day
2.13programs, extended week programs, summer school, and other programming authorized
2.14under the learning year program.
2.15EFFECTIVE DATE.This section is effective for revenue for fiscal year 2014
2.16and later.
