1.1A bill for an act
1.2relating to metropolitan government; providing for staggered, four-year terms
1.3for members of the Metropolitan Council; providing for removal of members
1.4under certain conditions;amending Minnesota Statutes 2010, section 473.123,
1.5subdivision 2a.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 473.123, subdivision 2a, is amended to
1.8read:
1.9    Subd. 2a. Terms. Following each apportionment of council districts, as provided
1.10under subdivision 3a, council members must be appointed from newly drawn districts as
1.11provided in subdivision 3a. Each council member, other than the chair, must reside in the
1.12council district represented. Each council district must be represented by one member
1.13of the council. The terms of members end with the term of the governor, are as follows:
1.14members representing even-numbered districts for terms ending the first Monday in
1.15January of the year ending in the numeral "7"; members representing odd-numbered
1.16districts for terms ending the first Monday in January of the year ending in the numeral
1.17"5." Thereafter the term of each member is four years, with terms ending the first Monday
1.18in January, except that all terms expire on the effective date of the next apportionment.
1.19A member serves at the pleasure of the governor. A member may be removed from office
1.20by the appointing body or person for misfeasance, malfeasance, or nonfeasance in office,
1.21upon written charges and after an opportunity to be heard in defense of the charges. A
1.22member shall continue to serve the member's district until a successor is appointed and
1.23qualified; except that, following each apportionment, the member shall continue to serve
1.24at large until the governor appoints 16 council members, one from each of the newly
1.25drawn council districts as provided under subdivision 3a, to serve terms as provided
2.1under this section. The appointment to the council must be made by the first Monday in
2.2March of the year in which the term ends.
2.3EFFECTIVE DATE.This section is effective for appointments made from districts
2.4drawn in 2013 and thereafter.
