1.1A bill for an act
1.2relating to public safety; creating a misdemeanor penalty for harassment or
1.3retaliation against a person subject to an order for protection or no contact order;
1.4amending Minnesota Statutes 2010, sections 518B.01, by adding a subdivision;
1.5629.75, by adding a subdivision.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 518B.01, is amended by adding a
1.8subdivision to read:
1.9    Subd. 24. Penalty; harassment or retaliation by petitioner. When an order for
1.10protection grants relief authorized in subdivision 6, paragraph (a), clause (2) or (3), it is
1.11a misdemeanor for the petitioner, with the intent of harassing or retaliating against the
1.12abusing party, to invite the abusing party to the petitioner's dwelling or residence or the
1.13surrounding area from which the abusing party is excluded, knowing that admittance is
1.14a violation of the order.
1.15EFFECTIVE DATE.This section is effective August 1, 2012, and applies to crimes
1.16committed on or after that date.

1.17    Sec. 2. Minnesota Statutes 2010, section 629.75, is amended by adding a subdivision
1.18to read:
1.19    Subd. 4. Penalty; harassment or retaliation by victim. When a domestic abuse
1.20order is issued against a defendant, it is a misdemeanor for the alleged victim protected
1.21under the order, with the intent of harassing or retaliating against the abusing party,
1.22to invite the defendant to the alleged victim's dwelling or residence knowing that such
1.23contact is a violation of the order.
2.1EFFECTIVE DATE.This section is effective August 1, 2012, and applies to crimes
2.2committed on or after that date.
