1.1A bill for an act
1.2relating to data practices; requiring destruction of automated license plate reader
1.3data; amending Minnesota Statutes 2012, section 13.82, by adding a subdivision.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 13.82, is amended by adding a subdivision
1.6to read:
1.7    Subd. 31. License plate data. (a) For purposes of this subdivision, "automated
1.8license plate reader data" means government data derived from an automated reader that
1.9captures motor vehicle license plate numbers.
1.10(b) Automated license plate reader data are private data on individuals or nonpublic
1.11data. Notwithstanding section 138.17, automated license plate reader data must be
1.12destroyed within 24 hours of collection of the data, unless the data identify a vehicle or
1.13license plates that have been stolen, there is a warrant for the arrest of the owner of the
1.14vehicle or the owner has a suspended or revoked driver's license, or the data are active
1.15investigative data.
1.16EFFECTIVE DATE.This section is effective the day following final enactment.
