1.1A bill for an act
1.2relating to education finance; clarifying that a school district is not required to
1.3provide educational services to students without disabilities from other states;
1.4amending Minnesota Statutes 2010, section 125A.515, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 125A.515, is amended by adding a
1.7subdivision to read:
1.8    Subd. 3a. Students without a disability from other states. A school district is not
1.9required to provide education services under this section to a student who:
1.10(1) is not a resident of Minnesota;
1.11(2) does not have an individual education plan; and
1.12(3) does not have a tuition arrangement or agreement to pay the cost of education
1.13from the placing authority.
1.14EFFECTIVE DATE.This section is effective July 1, 2011, for fiscal years 2012
1.15and later.
