1.1A bill for an act
1.2relating to energy; providing for a coal energy standard;proposing coding for
1.3new law in Minnesota Statutes, chapter 216B.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [216B.1696] COAL ENERGY STANDARD.
1.6    Subdivision 1. Definitions. (a) For the purpose of this section, the terms defined in
1.7this subdivision have the meaning given them.
1.8(b) "Electric utility" means a public utility providing electric service, a generation
1.9and transmission cooperative electric association, a municipal power agency, or a power
1.10district.
1.11(c) "Total retail electric sales" means the kilowatt-hours of electricity sold in a year
1.12by an electric utility to retail customers of the electric utility or to a distribution utility for
1.13distribution to the retail customers of the distribution utility.
1.14    Subd. 2. Coal standard. Each electric utility shall generate or procure sufficient
1.15electricity generated by coal technology to provide its retail customers in Minnesota, or
1.16the retail customers of a distribution utility to which the electric utility provides wholesale
1.17electric service, so that at least .... percent of the electric utility's total retail electric sales
1.18to retail customers in Minnesota are generated by coal in calendar year .... and each
1.19calendar year thereafter.
1.20    Subd. 3. Exemption. The prohibitions in section 216H.03, subdivision 3, do not
1.21apply to electricity generated by a coal-fired electric generation facility that is necessary to
1.22meet the standard of subdivision 2.
