1.1A bill for an act
1.2relating to transportation; municipal state-aid street fund; governing eligibility
1.3and apportionment;amending Minnesota Statutes 2010, section 162.09, by
1.4adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 162.09, is amended by adding a
1.7subdivision to read:
1.8    Subd. 11. Additional municipal state-aid street cities. (a) For purposes of this
1.9subdivision, the following terms have the meanings given them:
1.10(1) "local bridge project costs" means the total amount of money expended by a
1.11statutory or home rule charter city that, as determined by the commissioner in consultation
1.12with the city, is (i) directly attributable to, or directly resulting from, a trunk highway
1.13system project to construct a new bridge over the St. Croix River in Washington County;
1.14and (ii) not offset by other sources of state or federal funds; and
1.15(2) "state-aid eligible city" means any statutory or home rule charter city that incurs
1.16local bridge project costs and has a population of more than 4,000 but less than 5,000
1.17according to the most recent federal decennial census.
1.18(b) Notwithstanding subdivision 4, state-aid eligible city is deemed:
1.19(1) to have a population that is 5,000 for purposes of this chapter; and
1.20(2) notwithstanding section 162.13, subdivision 2, to have money needs equal to
1.21the local bridge project costs for the city.
1.22(c) Notwithstanding section 162.13, subdivision 1, the total apportionment to a
1.23state-aid eligible city, across all years in which this subdivision applies, may not exceed
1.24the most recent calculation of local bridge project costs for the city.
2.1(d) Except as provided in paragraph (e), the requirements of paragraph (b) apply to a
2.2city for 20 calendar years following the first year in which the city becomes a state-aid
2.3eligible city.
2.4(e) This subdivision does not apply if a city has a population of 5,000 or more as
2.5determined by the most recent federal decennial census or under subdivision 4.
