1.1A bill for an act
1.2relating to education; clarifying accountability measures for certain charter
1.3school student populations;amending Minnesota Statutes 2011 Supplement,
1.4section 124D.10, subdivision 10.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2011 Supplement, section 124D.10, subdivision 10,
1.7is amended to read:
1.8    Subd. 10. Pupil performance. (a) A charter school must design its programs to
1.9at least meet the outcomes adopted by the commissioner for public school students. In
1.10the absence of the commissioner's requirements, the school must meet the outcomes
1.11contained in the contract with the authorizer. The achievement levels of the outcomes
1.12contained in the contract may exceed the achievement levels of any outcomes adopted by
1.13the commissioner for public school students.
1.14(b) A charter school where 75 percent or more of enrolled students are eligible to
1.15participate in the graduation incentives program under section 124D.68 is exempt from
1.16the graduation rate measure that is one of the four multiple measures under Minnesota's
1.17federally approved 2012 No Child Left Behind Act waiver but shall be included in a
1.18group with alternative learning centers and contract alternative schools for purposes of
1.19determining "priority" schools or other consequences under that federal waiver.
1.20EFFECTIVE DATE.This section is effective the day following final enactment.
