1.1A bill for an act
1.2relating to education finance; requiring increases in permanent school fund
1.3allocations to districts to be reserved for school technology purposes;amending
1.4Minnesota Statutes 2011 Supplement, section 127A.33.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2011 Supplement, section 127A.33, is amended to read:
1.7127A.33 SCHOOL ENDOWMENT FUND; APPORTIONMENT.
1.8(a) The commissioner shall apportion the school endowment fund semiannually
1.9on the first Monday in March and September in each year, to districts whose schools
1.10have been in session at least nine months. The apportionment shall be in proportion to
1.11each district's adjusted average daily membership during the preceding year. Any annual
1.12apportionment in excess of $28 per pupil in adjusted average daily membership must be
1.13reserved and used only for the school technology purposes listed in paragraph (b). The
1.14apportionment shall not be paid to a district for pupils for whom tuition is received by
1.15the district.
1.16(b) For purposes of this section, revenue reserved under paragraph (a) for school
1.17technology purposes may only be used:
1.18(1) to purchase or lease computers and related materials, copying machines,
1.19telecommunications equipment, and other noninstructional equipment;
1.20(2) to purchase or lease assistive technology or equipment for instructional programs;
1.21(3) to purchase new and replacement library media resources or technology;
1.22(4) to pay for ongoing or recurring telecommunications or Internet access costs
1.23associated with Internet access, data lines, and video links; or
2.1(5) to pay for service provider installation fees for installation of new
2.2telecommunications lines or increased bandwidth.
2.3EFFECTIVE DATE.This section is effective for apportionments occurring on or
2.4after July 1, 2012.
