SENATE BILL No. 1148

 

 

February 23, 2010, Introduced by Senator PATTERSON and referred to the Committee on Education.

 

 

 

     A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

(MCL 380.1 to 380.1852) by adding section 1246a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1246a. (1) Except as otherwise provided in subsection

 

(3), the board of a school district or intermediate school district

 

shall not compensate the superintendent of the school district or

 

intermediate school district in an amount that exceeds an amount

 

equal to 75% of the compensation of the governor of this state.

 

     (2) Except as otherwise provided in subsection (3), the board

 

of a school district or intermediate school district or the board

 

of directors of a public school academy shall not compensate a

 

teacher in an amount that exceeds an amount equal to the

 

compensation of a member of the legislature of this state.

 


     (3) If an employment contract or a collective bargaining

 

agreement that provides compensation for an employee described in

 

subsection (1) or (2) is in effect as of the effective date of this

 

section, and if that compensation is not in compliance with

 

subsection (1) or (2), then subsection (1) or (2), as applicable,

 

does not apply to the compensation of that employee until after the

 

expiration of that employment contract or collective bargaining

 

agreement.

 

     (4) The superintendent of public instruction shall post the

 

dollar amounts of the maximum compensation prescribed in

 

subsections (1) and (2) on its website and shall promptly update

 

that posting if 1 or both of those dollar amounts change.
