SENATE BILL NO. 1081

June 14, 2022, Introduced by Senator BARRETT and referred to the Committee on Transportation and Infrastructure.

A bill to amend 2001 PA 142, entitled

"Michigan memorial highway act,"

by amending the title and section 2 (MCL 250.1002) and by adding section 2a.

the people of the state of michigan enact:

TITLE

An act to consolidate prior acts naming certain Michigan highways; to provide for the naming of certain highways; to prescribe certain duties of the state transportation department and the transportation asset management council; and to repeal acts and parts of acts and certain resolutions.

Sec. 2. The state transportation department shall only provide only for the erection and maintenance of suitable markers at the approach of any of the highways that are described in this act, when or are designated a memorial highway by the transportation asset management council under section 2a, if sufficient private contributions are received to pay the cost of erecting and maintaining those markers.

Sec. 2a. (1) Beginning on the effective date of the amendatory act that added this section, the transportation asset management council shall designate memorial highways under this act.

(2) The council may designate a memorial highway under this act only for an individual who did either of the following:

(a) Died in the line of duty in 1 of the following circumstances:

(i) In service to this state or a local community.

(ii) While serving in the United States Armed Forces.

(b) Demonstrated acts of great heroism or valor that disregarded his or her own safety to protect the lives of others.

(3) The council shall do all of the following:

(a) Create an electronic application form that must be made available on the council's website for the public to submit applications to designate a memorial highway under this act.

(b) Meet not less than 2 times per year to discuss, and approve or reject, applications to designate a memorial highway under this act.

(c) Develop procedures to notify an applicant that his or her application to designate a memorial highway under this act has been approved or rejected.

(4) As used in this section, "transportation asset management council" or "council" means the transportation asset management council created under section 9a of 1951 PA 51, MCL 247.659a.
