SENATE BILL NO. 845

March 17, 2020, Introduced by Senators JOHNSON and HOLLIER and referred to the Committee on Health Policy and Human Services.

A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 17757b.

the people of the state of michigan enact:

Sec. 17757b. (1) A pharmacist who is engaged in the business of selling drugs at retail shall do all of the following:

(a) Establish and maintain a record of the lot number of each prescription drug dispensed to a patient at the pharmacy.

(b) Notify a patient if a prescription drug dispensed by the pharmacy contains a lot number that is the subject of a recall by the prescription drug's manufacturer or the United States Food and Drug Administration.

(2) The board shall promulgate rules to implement this section, including, but not limited to, rules establishing a procedure for providing notice to patients under this section.
