AN ACT to make, supplement, and adjust appropriations for certain capital outlay projects for the fiscal year ending September 30, 2014; to provide for the expenditure of the appropriations; and to prescribe certain conditions for the appropriations.

PART 2

PROVISIONS CONCERNING APPROPRIATIONS

GENERAL SECTIONS

Sec. 201. In accordance with the provisions of section 30 of article IX of the state constitution of 1963, total state spending from state resources in this appropriation act for the fiscal year ending September 30, 2014 is $27,677,800.00. State appropriations paid to local units of government are $16,350,800.00 as follows:

Sec. 202. The appropriations authorized under this act are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.

MICHIGAN NATURAL RESOURCES TRUST FUND

Sec. 301. (1) The department of natural resources shall enter into agreements with local units of government for the purpose of administering the grants identified in part 1. Among other provisions, the agreements shall require that grant recipients agree to dedicate to public outdoor recreation uses in perpetuity the land acquired or developed; to replace lands converted or lost to other than public outdoor recreation use; and, for parcels acquired that are over 5 acres in size, to provide the state with a nonparticipating 1/6 minimum royalty interest in any acquired minerals that are retained by the grant recipient.

(2) The agreements under subsection (1) shall also provide that the full payments of grants shall be made only after proof of acquisition, or proof of completion of the development project, is submitted by the grant recipient and all costs are verified by the department of natural resources. This requirement may be waived by the department of natural resources.

Sec. 302. The appropriations in part 1 for capital outlay shall be carried forward at the end of the fiscal year consistent with the provisions of section 248 of the management and budget act, 1984 PA 431, MCL 18.1248.

Sec. 303. (1) The state share of the following capital outlay appropriations authorized in 2012 PA 283 for Michigan natural resources trust fund projects that have since been withdrawn by the grantees are reduced by the amounts indicated and the funds lapsed for the purpose of redirecting resources to Michigan natural resources trust fund projects appropriated in part 1:

(2) Any funds lapsed pursuant to subsection (1) shall be returned to the funds from which originally appropriated and are available for reappropriation.

Sec. 304d. If the use of land owned by the department is subject to certain conditions because of the source of funds used for the purchase of that land, or for the purchase of other land that was exchanged for that land, all of the following apply unless prohibited by federal law:

(a) The conditions shall be applied on a proportion of the land area that does not exceed the proportion of the funding for the acquisition of the land provided from that source.

(b) The department shall designate the part of the land to which the conditions apply.

(c) The part of the land to which the conditions apply shall be the less accessible part of the land. If 2 or more sources of funds used for the acquisition of the land subject the use of the land to conditions, the part of the land designated under subdivision (b) for the funding source imposing, in the department’s judgment, the strictest conditions shall be the least accessible, the part of the land designated for the funding source imposing the second-strictest conditions shall be the second-least accessible, and so on.

This act is ordered to take immediate effect.
