SENATE BILL No. 734

 

 

December 13, 2017, Introduced by Senators CONYERS, HERTEL, KNEZEK and PROOS and referred to the Committee on Local Government.

 

 

     A bill to amend 1991 PA 133, entitled

 

"An act to allow the use and recording of certain documents

regarding trusts in the case of real property that is conveyed or

otherwise affected by a trust; and to prescribe their effect,"

 

by amending section 4 (MCL 565.434).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 4. The A trust agreement or certificate of trust

 

existence and authority that accompanies an instrument as described

 

in section 1, and any amendments to or revocations of the trust

 

agreement or the certificate of trust existence and authority, may

 

be recorded in the office of the register of deeds of each county

 

where the lands that are the subject of or affected by the trust

 

agreement are located. If a trust agreement accompanies an

 

instrument, the trust agreement must be recorded as a separate

 


document.
