A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 13102 (MCL 333.13102), as amended by 2010 PA
375.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 13102. (1) An individual shall not tattoo, brand, or
perform body piercing on a minor who is under the age of 16.
(2) An individual shall not tattoo, brand, or perform body
piercing on a minor who is 16 or older unless the individual
obtains the prior written, informed consent of the minor's parent
or legal guardian and proof of that individual's authority to give
the
informed consent required under this section. subsection. The
minor's parent or legal guardian shall execute the written,
informed
consent required under this section subsection in the
presence of the licensee or an employee or agent of the licensee.
The minor's parent or legal guardian shall present to the licensee
or employee or agent of the licensee the minor's birth certificate
or legal proof of guardianship to establish the individual's
authority
to give the informed consent required under this section.
subsection. A licensee shall maintain the written, informed consent
that was executed by the minor's parent or legal guardian under
this subsection in the books and records of the body art facility
for at least 1 year.
