A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1293.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1293. Beginning with the 2020-2021 school year, the board
of a school district or intermediate school district or board of
directors of a public school academy shall ensure that each school
operated by the board or board of directors complies with the
following requirements for each classroom in which instruction on a
core subject area is provided:
(a) That there is an actual physical seat present in the
classroom for each pupil assigned to attend the classroom before
the pupil attends that classroom.
(b) If more than 35 pupils are assigned to attend the
classroom, the chief administrator of the school has obtained and
has on file for each pupil assigned to attend the classroom a
written permission form signed by the pupil's parent or legal
guardian before the pupil attends that classroom. The board or
board of directors shall provide the written permission form to the
parent or legal guardian of a pupil assigned to attend that
classroom. The permission form must include both of the following:
(i) The total number of pupils assigned to attend the
classroom.
(ii) A statement indicating that, if the parent or legal
guardian does not sign and submit the permission form, the pupil
will not be placed in the classroom.
(c) If the chief administrator of the school has not obtained
and does not have on file a written permission form as required
under subdivision (b), the chief administrator shall ensure that
the pupil is assigned to a classroom with fewer than 36 pupils.
