HOUSE BILL NO. 6411

A bill to amend 1969 PA 200, entitled

"An act to regulate driveways, banners, events, and parades upon and over highways; to provide for the promulgation of rules; to prescribe requirements for the issuance of permits; and to provide for the issuance of those permits,"

by amending section 5 (MCL 247.325).

the people of the state of michigan enact:

Sec. 5. The state transportation department of state highways shall make rules necessary for the administration of this act in accordance with the provisions of Act No. 88 of the Public Acts of 1943, as amended, being sections 24.71 to 24.80 of the Compiled Laws of 1948, and subject to Act No. 197 of the Public Acts of 1952, as amended, being sections 24.101 to 24.110 of the Compiled Laws of 1948. The boards as provided in the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328. A board of county road commissioners may adopt by reference the rules, in whole or in part, of the state transportation department of state highways or may adopt its own rules after a public hearing of which notice has been given as provided in this section. Before January 1, 2022, notice of a hearing under this section must be provided by publication at least twice in a newspaper circulated in the county not more than 30 days nor less than 7 days prior to before the hearing. Beginning January 1, 2022, notice of a hearing under this section must be posted as provided in the local government public notice act.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 6440 (request no. 02449'19) of the 100th Legislature is enacted into law.
