HOUSE BILL NO. 6224

A bill to amend 1979 PA 152, entitled

"State license fee act,"

by amending section 5 (MCL 338.2205), as amended by 2004 PA 263.

the people of the state of michigan enact:

Sec. 5. (1) Except under rules promulgated by the department pursuant to this section or as provided under section 411 of the occupational code, a fee collected by the department, when paid pursuant to this act, shall not be refunded.

(2) A fee collected by the department under this act is not refundable except as provided under rule promulgated by the department, under section 411 of the occupational code, or under the circumstances described in subsection (2). The department shall promulgate rules concerning the refund of fees , under this subsection pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.

(2) The specific amount of any application, license, registration, examination, or other similar fee set forth in this act must be reduced to the extent that the specified amount does not bear a reasonable relation to the costs incurred by the department incident to the application, licensing, registration, examination, or other similar fee-generating program or activity. By not later than March 1 of each year, the department shall report in writing to the chairpersons of the house and senate appropriations committees the department's analysis of the reasonableness of all application, license, registration, examination, and other similar fees charged pursuant to this act in the immediately preceding calendar year and the department's determination as to whether the amount of each of those fees bears a reasonable relation to the costs incurred by the department incident to the application, licensing, registration, examination, or other similar fee-generating program or activity.
