HOUSE BILL No. 6142

 

 

June 7, 2018, Introduced by Reps. Clemente, Hammoud, Wittenberg, Moss, Sowerby, LaGrand, Yancey, Santana, Zemke and Chang and referred to the Committee on Natural Resources.

 

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

(MCL 324.101 to 324.90106) by adding section 5503a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5503a. Notwithstanding any other provision of this part,

 

in determining whether to issue a permit under this part, the

 

department shall consider whether the permit would adversely affect

 

public health in the vicinity of the proposed permitted facility

 

after considering all of the following socioeconomic factors

 

related to residents in the vicinity of the proposed permitted

 

facility:

 

     (a) Education background, as measured by the highest year of

 

school completed or other similar categorical variable.

 

     (b) Income level.

 

     (c) Health behavioral criteria, such as adult obesity rates


and access to healthy food and exercise opportunities.

 

     (d) Clinical care variables, such as primary care physician

 

accessibility, rates of health insurance coverage, asthma rates,

 

and rates of mammography screening, diabetes screening, and

 

screening for other significant health factors.

 

     (e) Physical environmental factors such as housing problems

 

and other environmental exposures, such as water pollution.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
