HOUSE BILL No. 5648

 

May 17, 2012, Introduced by Rep. McMillin and referred to the Committee on Commerce.

 

     A bill to amend 1966 PA 346, entitled

 

"State housing development authority act of 1966,"

 

(MCL 125.1401 to 125.1499c) by adding section 13.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 13. (1) Notwithstanding any other provision of this act,

 

the authority shall not award grants, make direct loans, make

 

indirect loans through a lender, or otherwise expend money for

 

commercial development unless all of the following requirements are

 

met:

 

     (a) The commercial development is part of a housing project or

 

housing development and not less than 75% of the expenditures by

 

the authority for the housing project or housing development are or

 

will be for residential development.

 

     (b) The commercial development will serve and improve the

 


residential development referred to in subdivision (a).

 

     (c) The commercial development will be in the immediate

 

vicinity of the residential development referred to in subdivision

 

(a).

 

     (d) The commercial development will provide for basic domestic

 

needs such as those served by a supermarket, clothing store,

 

hardware store, or drug store when these needs are not already

 

served within the immediate vicinity of the residential development

 

referred to in subdivision (a).

 

     (2) Notwithstanding any other provision of this act, the

 

authority shall not expend money for any of the following:

 

     (a) Commercial building façade improvements except as part of

 

commercial development within the expenditure limits of subsection

 

(1).

 

     (b) Wireless internet access, sculpture, or other special

 

projects not necessary to provide housing.
