HOUSE BILL NO. 5121

A bill to amend 2017 PA 202, entitled

"Protecting local government retirement and benefits act,"

(MCL 38.2801 to 38.2812) by adding section 4a; and to repeal acts and parts of acts.

the people of the state of michigan enact:

Sec. 4a. (1) Subject to subsection (2), if a retirement system provides a disability retirement pension benefit for a retirant who is a retired firefighter or police officer of the local unit of government, and the retirant was disabled in the line of duty, the retirement system shall not reduce the retirant's disability pension benefit if the retirant earns income from gainful employment.

(2) If the local unit of government that sponsors the retirement system described in subsection (1) is a city described in section 4p(1) of the home rule city act, 1909 PA 279, MCL 117.4p, subsection (1) is subject to a plan for adjustment. As used in this subsection, "plan for adjustment" means that term as defined in section 4p of the home rule city act, 1909 PA 279, MCL 117.4p.

Enacting section 1. Section 2 of the protecting local government retirement and benefits act, 2017 PA 202, MCL 38.2802, is repealed.
