HOUSE BILL NO. 4959
A bill to amend 1933 PA 254, entitled
"The motor carrier act,"
by amending section 9 of article V (MCL 479.9), as amended by 2014 PA 493, and by adding section 9a of article V.
the people of the state of michigan enact:
ARTICLE V
Sec. 9. (1) The commission has full power and authority to make and shall make insurance or bond requirements for intrastate-only motor carriers of general commodities and motor carriers of household goods as it deems necessary to protect the interests of the public.
(2) A motor carrier subject to this act must demonstrate compliance with the worker's disability compensation act of 1969, 1969 PA 317, MCL 418.101 to 418.941, and shall demonstrate compliance to the commission under the following circumstances:
(a) Upon initial application for operating authority under this act.
(b) Upon request of the commission, if the motor carrier's worker's compensation insurance has lapsed.
(3) The commission shall work with the worker's compensation agency to implement the requirements of subsection (2).shall provide to the commission, at least weekly, a list of motor carriers subject to this act whose worker's disability compensation insurance has lapsed or was canceled by the insurance carrier.
Sec. 9a. Not later than the tenth day of each month, the commission shall publish both of the following on its website:
(a) A list of all motor carriers subject to this act that have applied for a certificate of authority under this act during the previous month.
(b) A list of all motor carriers subject to this act whose certificate of authority issued under this act was approved, suspended, revoked, or reinstated during the previous month.
