May 11, 2017, Introduced by Reps. Howrylak, Wittenberg, Gay-Dagnogo, Lucido, Hoadley, Pagan, Geiss and Sabo and referred to the Committee on Health Policy.

 

     A bill to amend 1978 PA 368, entitled

 

"Public health code,"

 

(MCL 333.1101 to 333.25211) by adding sections 16112 and 20135.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 16112. A health professional licensed, registered, or

 

otherwise authorized to engage in a health profession under this

 

article shall comply with section 20135. A health professional who

 

violates section 20135 is subject to any penalty, remedy, or

 

administrative sanction applicable to a violation of this article.

 

     Sec. 20135. (1) Except as otherwise provided in this section,

 

a health care provider shall not refuse to provide health care

 

services or supplies to a patient based solely on the patient's

 

refusal to allow the health care provider to photocopy or scan his

 

or her driver license or Michigan personal identification card.

 

This section does not prohibit a health care provider from viewing


the license or card to verify the patient's identity or from

 

capturing data from the license or card for the health care

 

provider's database.

 

     (2) As used in this section, "health care provider" means any

 

of the following:

 

     (a) A health professional licensed, registered, or otherwise

 

authorized to engage in a health profession under article 15.

 

     (b) A health facility or agency licensed or certified under

 

this article.
