HOUSE BILL NO. 4246

February 16, 2021, Introduced by Reps. LaFave, Damoose, Maddock, Steven Johnson, Markkanen and Outman and referred to the Committee on Transportation.

A bill to amend 1964 PA 283, entitled

"Weights and measures act,"

(MCL 290.601 to 290.635) by adding section 28g.

the people of the state of michigan enact:

Sec. 28g. (1) The department must produce a sticker for display on each motor vehicle fuel pump from which motor vehicle fuel is dispensed for sale at retail in this state. All of the following apply to the sticker described in this subsection:

(a) The sticker must show the federal motor vehicle fuel tax rate and the state motor vehicle fuel tax rate, in cents per gallon, for gasoline and for diesel fuel.

(b) The sticker must measure at least 3.5 inches on each side.

(c) The department must distribute the sticker to all state and local inspectors and sealers who inspect or seal motor vehicle fuel pumps in this state under this act.

(d) The department must produce and distribute a new sticker each time the federal or state motor vehicle fuel tax rate changes.

(2) At the time he or she inspects or seals a motor vehicle fuel pump, a state or local inspector or sealer who inspects or seals motor vehicle fuel pumps under this act must place the sticker required under subsection (1) on the pump he or she is inspecting or sealing. The inspector or sealer must display the sticker on the face of the pump so that it is clear, conspicuous, and prominent to consumers.

(3) An owner or operator of a motor vehicle fuel pump from which motor vehicle fuel is dispensed for sale at retail is not responsible for affixing or maintaining a sticker under this section.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
