HOUSE BILL NO. 4212

A bill to amend 1961 PA 236, entitled

"Revised judicature act of 1961,"

(MCL 600.101 to 600.9947) by adding sections 2980 and 2981.

the people of the state of michigan enact:

Sec. 2980. (1) An individual who violates section 9 of 1927 PA 372, MCL 28.429, is liable for economic and noneconomic damages that arise from the injury, including, but not limited to, death of another individual that results from the violation.

(2) The remedy provided by this section is in addition to any other remedy provided by law.

Sec. 2981. (1) An individual, other than an officer or employee of a state or local governmental entity in this state, may bring an action against an individual who violates section 9(1) of 1927 PA 372, MCL 28.429.

(2) In an action under this section, the court shall award damages against the individual who violated section 9(1) of 1927 PA 372, MCL 28.429, in an amount of not less than $10,000.00 for each violation.

(3) The remedy provided by this section is in addition to any other remedy provided by law.

Enacting section 1. This amendatory act does not take effect unless House Bill No. 4144 of the 102nd Legislature is enacted into law.
