An Act Relative to Package Store Employees.



                Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

            SECTION 1.    Chapter 138 of the Massachusetts General Laws is hereby amended by inserting after section 15E, the following new section:

Section 15 F.  Notwithstanding any general or special law to the contrary, all employees of a store licensed to sell alcohol to be consumed off the premises as licensed by Section 15 of Chapter 138 shall be at least twenty-one years of age. The commission shall enforce the requirements of this section, by administrative proceedings, against a person licensed under this section whose employee is under twenty one years of age and directly handles or sells alcoholic beverages in violation of this section, as follows: -

(1)   a first violation of this section shall be punished by a fine of not less than $1000.

(2)   A second violation of this section shall be punished by a suspension of the licensee’s license for a length to be determined by the commission and a fine of $5,000.

All persons employed by a licensee under section 15 of chapter 138 at the time of the enactment of this section shall be exempt.
