Summary

Repeal and reenact all sections of KRS 198B.700 to 198B.738, relating to home inspectors, as new sections of KRS Chapter 324, relating to real estate brokers and salesmen; define terms and make various technical changes to differentiate between real estate licenses and home inspector licenses; modify board member appointments and voting requirements; establish a board member and staff code of ethics with accompanying disciplinary procedures; clarify home inspector course-of-study requirements; add reasonable costs of services and the power to create a consumer protection fund to the board's revolving fund; create a detailed procedural scheme for processing complaints against inspector licensees and holding any subsequent hearings concerning complaints; authorize hearings on inspector license denial or other discipline; conduct all administrative hearings and appeals in accordance with KRS Chapter 13B; require the board to publish an annual compilation of its decisions, actions, and orders concerning inspector licensee complaints; designate types of and reasons for disciplinary sanctions against inspector licensees; allow renewal or reinstatement of inspector licenses; permit board intervention when an unlicensed person attempts to conduct home inspections; direct the Kentucky Real Estate Commission to provide administrative support and legal assistance to the board; create a new section of KRS Chapter 324 to attach the board to the commission for administrative purposes; maintain the board's authority to promulgate administrative regulations to administer and enforce the home inspector statutes; limit the commission's ability to overrule any action of the board; require the board to give the commission the opportunity to advise and comment on the board's planned administrative regulations or any other matter the board chooses; preclude the home inspector statutes from being construed to affect the commission's licensees or the jurisdiction of the commission; amend KRS 198B.030, 198B.040, 198B.4005, 227.300, 227.530, 227.560, 227A.040, 236.030, 318.077, 318.130, 411.270, and 413.246 to conform.
