Summary
Create a new section of Subtitle 17A of KRS Chapter 304 to require the Department of Insurance to authorize out-of-state insurers to offer health benefit plans in Kentucky; authorize the commissioner to conduct market and solvency examinations in accordance with Subtitle 2 of KRS Chapter 304 of the out-of-state companies offering health benefit plans to Kentucky residents; authorize the exemption of Kentucky state-mandated health benefits from out-of-state health benefit plans; require the out-of-state insurer to include language in the application for a plan and in the policy for a health benefit plan to make it obvious that the insurer is regulated by the laws of another state, the Kentucky Department of Insurance does not have jurisdiction over the insurer, and Kentucky's health benefit mandates do not apply; provide that the laws and regulation of Kentucky are not applicable to out-of-state health benefit plans; amend KRS 304.17A.005 to provide that plans offered by out-of-state insurers are within the definition of "health benefit plan."
