Summary
Create a new section of Subtitle 17A of KRS Chapter 304 to define "physician profiling program"; create a new section of Subtitle 17A of KRS Chapter 304 to prohibit disclosure of the results of a physician profiling program to the public unless the program complies with Sections 1 to 3 of this Act and has been approved by an independent oversight entity; create a new section of Subtitle 17A of KRS Chapter 304 to authorize the Office of Insurance to promulgate regulations to ensure that physician profiling programs include specified requirements; create a new section of Subtitle 17A of KRS Chapter 304 to provide that Sections 1 to 3 of this Act shall not prohibit or limit a cause of action against a person or entity for a violation; provide that a person who publicly discloses or uses for network or reimbursement purposes any profiling results in violation of this Act or any regulations promulgated pursuant thereto shall be liable to the physician or the physician's group for treble damages, attorney's fees, and any other appropriate relief.
