Synopsis: Health standards for farmers' markets. Requires the state department of health to adopt rules to establish guidelines concerning health and sanitary standards for food sold at farmers' markets and roadside stands. Prohibits a city, town, or county from adopting an ordinance concerning health and sanitary standards for food sold at farmers' markets.

    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 16-18-2-123.1; (13)IN0411.1.1. -->     SECTION 1. IC 16-18-2-123.1 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 123.1. "Farmers' market", for purposes of IC 16-42-5.5, has the meaning set forth in IC 16-42-5.5-1.
SOURCE: IC 16-42-5.5; (13)IN0411.1.2. -->     SECTION 2. IC 16-42-5.5 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]:
     Chapter 5.5. Farmers' Markets
    Sec. 1. As used in this chapter, "farmers' market" means a common indoor or outdoor area where two (2) or more farmers, growers, or producers gather on a regular basis to sell directly to consumers farm or locally grown products that they grow or produce.
    Sec. 2. Subject to IC 16-42-5-29, the state department shall adopt rules under IC 4-22-2 to establish guidelines concerning health and sanitary standards for food sold at farmers' markets

and roadside stands.
    Sec. 3. A city, town, or county may not adopt an ordinance concerning health and sanitary standards for food sold at farmers' markets and roadside stands.
