SENATE BILL No. 112



    A BILL FOR AN ACT to amend the Indiana Code concerning alcohol and tobacco.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 7.1-3-27; (11)SB0112.2.1. -->     SECTION 1. IC 7.1-3-27 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]:
    Chapter 27. Services Between Wholesalers
    Sec. 1. (a) An alcoholic beverage wholesaler may provide the following services to another alcoholic beverage wholesaler regarding any alcoholic beverage:
        (1) Receiving and storing alcoholic beverages.
        (2) Insuring alcoholic beverages against risk of loss or damage while in the possession or control of the wholesaler that is insuring the alcoholic beverages.

         (3) Preparing orders received from the wholesaler that is selling the alcoholic beverages for delivery to retailers and dealers.
        (4) Transporting alcoholic beverages to or from retailers and dealers.
        (5) Delivering alcoholic beverages to retailers or dealers.
        (6) Preparing and delivering invoices for alcoholic beverages shipped to retailers or dealers.
        (7) Preparing and collecting proof of delivery of alcoholic beverages.
        (8) Collecting, as an agent for the wholesaler that is selling the alcoholic beverages, payments required by law to be made at the time of delivery of the alcoholic beverages.
        (9) Depositing money collected from retailers and dealers on behalf of the wholesaler that is selling the alcoholic beverages.
        (10) Maintaining records in connection with services provided by one wholesaler to another wholesaler.
        (11) Preparing and transmitting information regarding the services provided.
        (12) Making payments to the wholesaler that is selling the alcoholic beverages for loss of or damage to the wholesaler's alcoholic beverages while in the possession of the wholesaler providing the services.
        (13) Other services approved by the commission.
    (b) An alcoholic beverage wholesaler may not provide the following services to another alcoholic beverage wholesaler:
        (1) Soliciting or accepting orders for alcoholic beverages from retailers or dealers.
        (2) Providing post-delivery sales or promotional services to retailers or dealers.
    Sec. 2. The commission may adopt rules to establish terms and conditions applying to the services that one wholesaler may provide to another wholesaler under section 1 of this chapter.
    Sec. 3. This chapter does not authorize a wholesaler to:
        (1) acquire an interest in another wholesaler in violation of any provision of this title; or
        (2) otherwise violate any provision of this title.
