A HOUSE RESOLUTION urging the legislative council
to assign the topic of fugitive dust to a study committee.
Whereas, Fugitive dust is particulate matter that becomes
airborne and has the potential to adversely affect human health
or the environment;
Whereas, High levels of dust particles often originate from
activities such as agriculture, mining, construction, and
manufacturing;
Whereas, House Bill 1158-2013 defines "fugitive dust" as the generation of particulate matter to the extent that some portion of the material escapes beyond the property line or boundaries of the property, right-of-way, or easement on which
the source is located;
Whereas, House Bill 1158-2013 also provides that certain
regulations related to fugitive dust emissions do not apply to
agricultural operations, including agricultural operations
conducted by an agricultural cooperative, association, or
agribusiness that services growers;
Whereas, In order to assure the safety and continued good
health of all Hoosiers, it behooves the state of Indiana to study
all aspects of fugitive dust and the regulations that relate to it:
Therefore,
SECTION 1. That the Indiana House of Representatives urges the Legislative Council to assign to a study committee the topic of fugitive dust and the regulations relating to it.
SECTION 2. That the committee, if established, shall operate under the direction of the Legislative Council and that the committee shall issue such reports as directed by the council.
