Synopsis: Recording of title for mobile or manufactured homes. Provides that a person to whom a certificate of title is issued by the bureau of motor vehicles after June 30, 2011, for a mobile home or a manufactured home shall record the certificate of title and the certificate origin, if the certificate of title is the first issued in Indiana, with the county recorder of the county in which the mobile home or manufactured home is to be located.

Effective: July 1, 2011.

HOUSE BILL No. 1449



    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 9-17-2-18; (11)IN1449.1.1. -->     SECTION 1. IC 9-17-2-18 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 18. (a) This section applies only to a mobile home for which a certificate of title is issued under this chapter after June 30, 2011.
    (b) As used in this section, "mobile home" has the meaning set forth in IC 9-22-1.5-1.
    (c) A person to whom a certificate of title for a mobile home is issued under this chapter shall record the following documents with the county recorder of the county in which the mobile home is to be principally located:
        (1) The certificate of title.
        (2) The manufacturer's certificate of origin as provided in IC 9-17-8, if the certificate of title referred to in subdivision (1) is the first certificate of title issued for the mobile home in Indiana.

SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 15.5. (a) This subsection applies only to a certificate of title issued under this chapter after June 30, 2011. A person to whom a certificate of title for a manufactured home is issued under this chapter shall record the following documents with the county recorder of the county in which the manufactured home is to be located:
        (1) The certificate of title.
        (2) The manufacturer's certificate of origin as provided in IC 9-17-8, if the certificate of title referred to in subdivision (1) is the first certificate of title issued for the manufactured home in Indiana.

     (b) The filing in the appropriate county recorder's office of the affidavit of transfer to real estate with the retired certificate of title, if available, is deemed a conversion of the manufactured home that is attached to real estate by a permanent foundation to an improvement upon the real estate upon which it is located. However, a filing under this section is not required for a person who converts a manufactured home that is attached to real estate by a permanent foundation to an improvement upon the real estate upon which it is located.
